Who owns copyright on screenshots and images taken in game? Is there and where is a ZoS policy?

[*] Don't use anything related to The Elder Scrolls IP in such a way that would be considered inappropriate (vulgar, obscene, pornographic, etc.) or damaging to the IP.
    [/list]

There's rule in internet that says otherwise: Rule 34!!! :D

I had too look up rule 34...on that topic I was surprised at all the hits!

When I did an appropriate google search...apparently there's a lot of violators to this rule with regards to eso

But that brings another question....what is considered to be vulgar, obscene and harmful to the IP of a game with a rating of M?

We can help clarify this. (For your own peace of mind, the info below was vetted by our legal team.)

Bethesda Softworks®, and ZeniMax® Online Studios ultimately own the copyrights and trademarks for The Elder Scrolls Online®: Tamriel Unlimited™, and anything related to it. Everything mentioned in the first post sounds fine. Generally speaking, we're fine with fan creations and even enjoy sharing them, but there are a few things to watch out for. Here are some key points:
    • Creations using our IP or assets must be in accordance with our Terms of Service, Code of Conduct and Privacy Policy, all of which are linked to on our website.
    • Don't use anything related to The Elder Scrolls IP in such a way that would be considered inappropriate (vulgar, obscene, pornographic, etc.) or damaging to the IP.
    • Don't claim anything related to The Elder Scrolls IP as your own original creation. It should include all copyright, trademark, and other legal notices related to The Elder Scrolls Online: Tamriel Unlimited, Bethesda Softworks, and ZeniMax Online Studios.
    • Don't use anything related to The Elder Scrolls IP for monetary gain or in a commercial context. In short, if you create something using The Elder Scrolls IP, you may not sell it or otherwise use it for monetary gain.

@ZOS_JessicaFolsom have you talked to IGN then? They bashed the game pretty hard and spammed it on their facebook constantly, all while bashing the game, and using ingame footage and misleading titles of articles to get people to click the link which in turn brought views to their page which in turned the advertisers on their sites paid them for per page view. If that is not monetary gain then I dont know what is. Just saying :) you guys could own IGN and then write all the 10/10 reviews for the game you want since that is how IGN works anyways. Pay them to write good reviews, dont pay them you get crappy reviews (in most cases, some games deserve their bad reviews as well as good).

@Gorthax I would suggest deleting that comment if you're in the USA regarding copyright issues the only person who can confront a copyright violator is the copyright owner....for all you know ign could have a contract with ZoS and this could put you at risk. You are allowed to privately send zos a letter informing them that you suspect infringement that they may be interested in but to openly make an accusation on a forum is probably asking for the person you are bashing to take you to court.

Also there is fair use clause which ign may be perfectly in line with. Ultimately it is between ZoS and ign and outside of informing the copyright holder the correct action is silence.

my giveadamn is busted :) so no I will not edit that comment. They said it could not be allowed for monetary gain and IGN did exactly that :) I was just pointing that out in regards to the monetary thing. Pointing out how it was used for monetary gains in that regards of ads. Thats all it was. nothing more nothing less :)

IGN (and any other website) is, technically, selling its user's page clicks. It uses original content accompanied by screenshots to do that, but it's not directly selling anything from ESO. If IGN decided to print out screenshots as posters and sell those, then Zenimax would probably take legal action.

This game breaks away from The Elder Scrolls IP in a ton of ways. Should we go by your MMO that is loosely based on TES lore or by actual TES lore?

Everything you mention here makes a pretty strong case to never let Angry Joe EVER play a Zenimax Online Studios game again. He damaged the IP, used images from ESO but offered no trademarking, and ultimately used his video as click bait to promote his own Channel. Too bad this wasn't a legally binding contract that would allow civil suit =s

Of course it is a legally binding contract, anyone playing the game agreed to this as it is in the TOS/EULA. If you are playing the game you agreed and "signed" a contract with this info in and from what I know ZOS could very easily bring a civil/criminal suit against anyone they think has violated the contract.

    IANAL.

Parody does not break copyright Law, this for instance we see with the "Downfall" videos on YT. This goes under the "fair use" term and if you check YT, then most streamers have this written in their description. (US Law)
