Very average FPS for new high end custom built games laptop

Hi there, not sure if anyone can help with this and just so you know my technical expertise is very limited so would appreciate any response in simple terms. During beta I noticed my games laptop which at 2 years old was getting on I suppose but still handles almost anything fairly well. I was getting pretty low fps especially in ava (20-40) and regular pve (40-60). high settings
I decided to upgrade for preorder and had a custom built laptop made by scan.co.uk. Spec is:
Core i7 4700 2.4ghz quad core 6mb cache
16gb memory
3gb NVidea GTX770M
OS Windows 7 home premium 64 bit.

I really expected to fly with this rig, but when I signed in I noticed my laptop had been set to medium, where I'm pretty sure my old one defaulted to high, despite being 2 years older. I currently get 45-75 fps high settings 40-55 ultra, though this drops to as low as 35 at high in ava.
Spoke to a few of the techies in my guild and they are sure I should be capping at 100 fps with this rig. I'm baffled how eso defaults this as lower spec as my old laptop, can't help but think it might be an issue with the graphics card though driver is showing up to date (version 335.23)

Please make sure that in your mobility power options you have it set for "high performance", especially with the PCI linkstate option.
Otherwise, please make sure Optimus isn't defaulting to your Intel GPU due to your machine being confused about a low power state.
Install your nVidia driver with "clean installation" radiobox checked.
Otherwise, be informed that you're using a Mobile Card, which isn't a direct equivalent to desktop cards.

Notebookcheck states that your card should have a 192 bit memory bus, and use GDDR5. If that's the case, I am a bit puzzled, and if you could confirm this I would appreciate it. A shorter bus or slower video memory will absolutely hamper your framerate.
Not at all the same card, but I had a high end laptop from a few years ago. It has two 560Ms, and I only receive about 20-30 FPS at best with high settings, even though a card like that should eat this game up. I'm eager to see what SLI does, but as we all know this game doesn't have an SLI profile yet.

I'm not a techie, though i can put together a computer!

But i'd like to ask, are you running any other programs while playing, if so which ones?
Also how hot is your cpu, and does it show spikes in usage when your fps drops?

If you get fps drops in high populated areas, that is normal. i personally have a monster computer, built it myself under professional guidance and spent 2600$ dollars on it, but i still have the occasional fps drop in high populated areas.

Do you have v sync turned off or on as well?

Good thought, your computer may be using thermal throttling to regulate heat, ergo when your CPU/GPU is under extreme stress it may be cutting power to reduce.
Also, Vsync is tricky like that; it could totally be to blame.

I can't stress enough, the more RAM, the better; in this case, not just RAM but VRAM too. The wider the memory bus, the better, too! My SLI'd 660 Ti really screams, but when I transition from area to area, but 192 bit bus really shows its weakness.
