I just started the game after a break, and had to agree to a long wall of text, and i had to understand it all, otherwise i would not have been allowed to play ESO anymore. How many of you can say they read and understood 100% of this new agreement or whatever it's called?

I hope admitting they have not read and/or understood the TOS doesn't get the users it concerns into trouble - because that's literally what you confirm by accepting the terms. As if someone was strict the confirmation could be considered as void, with all the consequences that brings. Just saying.

They make these things impossible for non-lawyers to understand on purpose. If you sign without understanding, you are doing exactly what ZOS/MS wants.

Read; understood; have an advantage because I have experience writing these things; agree that they can be quite opaque and/or of little interest to the average reader; they're pretty ubiquitous these days and most scroll and agree as quickly as possible and and have little idea what's in them; and sadly doubt anything about the above is going to change soon.

I read the whole thing, but it's "modified" legalese, and I'm not all that conversant with legalspeak, modified, modernized, sanitized, whatever....

Agreed, but for most players there's no point in reading any of it at all. Either you want to play the game, in which case you have to accept the agreement regardless, or you're not bothered whether you play the game in which case you have a choice whether to accept the agreement or not and might therefore want to read it. However, most just want to play the game.

The chances are that if there was something controversial in any change it would be raised on the forum, and if there was something wholly outrageous and unacceptable - such as requiring players to allow ZOS to seize their first born - then the courts would throw it out as unenforceable anyway!

No, I couldn't read it as they displayed it in a language I couldn't fully understand. I'm an English speaker living in Japan.

Unless they highlight the changes it is scroll to the bottom accept and move on, if they are stupid enough to put something highly illegal in there it will come back to bite them in time.

Got more than 5K hours in this game I know people with double or more hours than that, not about to just go, well you know I don't accept those terms and lose access to the game.

It's just for ZOS to escape liability, in case the end user tries to file some kind of litigation against them for whatever, ZOS lawyers can turn around and say "They agreed to the EULA, we're not at fault".

Some people here just love a good witch hunt wanting to think someone's out to get them.

The only thing I stated, meant as a friendly hint, was that it might not be a good idea to click "I have read and understood..." and then openly say that you (generic you) have not read and understood - because that could be seen as revoking, at least in some places. That's all.

Nah they won't do anything. If you agreed then you agreed, regardless of whether you truly understand the wording or not. It's also an implication that you at least understand you're agreeing to the terms in the first place. It's not like they're gonna ban your account because you admit you didn't read every word.

The display on my PS5 was very hard to read and I couldn't get to scroll, so I didn't read it. That should have been an option on the poll BTW.

Check and see where many of these TOS are not held to be legally binding. Nothing jumps out in ZOS's TOS. Where this comes in to play is more in the subscription area. And even subs have been revoked as legally binding (California especially has a lot of cases involving Blizzard on this)

    I don't see any concern?

    (Insert South Park HumancentiPad meme)

"NO! YOU DIDN'T READ IT!" :D

Why is it that with video games we are never presented with the Terms until after we've purchased, downloaded, installed and are finally playing the games? Shouldn't the Terms be presented and (dis)agreed upon before we've made our purchase!?

Anyway, I've been playing ESO for 10 years and have spent tons of money and time on it. So I'm not gonna disagree to some new change in the Terms and just forfeit everything. It's not like if I were to disagree that they'll give my money and time back... This ship has sailed.

Some EULAs already do this, but it should become a legal requirement: For each change, they should summarise the changes in non-lawyerese at the beginning and highlight the sections that actually changed in the document.
