Bug with Shadow passive

If you're a nightblade, the shadow passive (5K armor/spell resist after casting a shadow ability) often bugs out in pvp. Occurs after a death or porting, if you check your character screen you'll notice the shadow passive no longer working. The only ways to fix this are either leaving cyrodil and braving the queue to renter, or by going to a delve.
I"ve posted this in the bugs section of forum and reported in game, with no interest at all by ZOS, hopefully ppl here will recognise its a huge bug for nightblades.
