A whole split second? You poor thing...
This is similar to the bug with snipe I've been fighting for who knows how long. You fire snipe at a target, weapon swap to a different weapon before the arrow reaches it's target, and the snipe will deal no damage (because you're no longer wielding a bow).
This game's ability resolution sucks.
So... you shoot an arrow before using cloak(or whatever that was), you then use cloak, but have it break when the attack hits the enemy?
that has been going on for quite some time now, and is not an issue with the ability. Shoot your ranged ability, wait for it to hit, THEN use cloak. After that its a matter of hoping it does not break on you for no reason.

It does not break if you do this in 1.5, this is a new thing that only started in 1.6.2. I'd argue that I should be able to use any action I wish BEFORE using cloak and not have it break.
I have a suggestion. Make the ability a toggle, like any MMO cloak and drop combat and instantly enter sneak, and make it unbreakable by anything other than AoE and the new flare ability, or detection potions.
Cloak I - Drains 1000 Magic every 1 second. Magicka regen is stopped.
Cloak II - Drains 750 Magic every 1 second. Magicka regen is stopped.
Cloak III - Drains 500 Magic every 1 second. Magicka regen is stopped.
Cloak IV - Drains 500 Magic every 1 second. Magicka regen is 25% of total.
PTS numbers btw... I know 1k magic drain on live would be killer.
Or just you know... Fix the ability. Period.
