     I've failed to upgrade with a supposed 100% chance a few times. Not sure if that's by design or not, but it kinda sucks losing a rare-ish set piece plus the tempers

     100% agree. Not being able to use a potion while attacking or moving is the most stupid thing in this game and I have died countless times because of it.
