Luminous Shards now damages NPCs

For a while now, Luminous shards damages NPC's whether this is by design or not, the weapon tribute states "Send your spear........ magic damage ENEMIES (not friendly) in the area" and I am now getting a bounty for something I should not nor in the last 6 years ever have. Why?
