Crown Crate rewards guarantee of Superior reward or better not always working

As you unlock items in your collection from crown crates, the system will increasingly keep rewarding you items you already have and convert that reward to only a smaller portion of gems that the item would have cost if you attempted to purchase it with gems. Because you don't receive the full amount of gems and you don't receive the Superior item, this issue happens more and more often as things are unlocked in a player's collection. So effectively as of right now, the information on the ESO site is wrong, you are NOT guaranteed of winning any items of Superior or better!

Additionally, I found this explanation of what defines illegal gambling quoted from 'Mark Theoharis' https://massivelyop.com/2017/01/17/__trashed-3/:
“An illegal lottery in the US consists of three elements – 1) some kind of consideration (money or something of value) for entry, 2) random chance, and 3) a prize with some value.”
In the case of ESO, you do purchase crowns crates with money, the guarantee is not working and ESO own site listed above even displays the chances for winning, plus many of the items you can win from the crates can be given a value as some of them are purchasable from the store, I think the question need asked, "Is ESO running an illegal lottery?"
