changes in TOS

Capacity is also a serious issue as well. These things are not written in plain text. By definition, they are not understood by the people agreeing to them. Intentionally obfuscating a contract is grounds to argue for its annulment.

Even the arbitration agreements have been ignored in the past due to it favouring one party over another to greatly.

    Remember the law is arguable.

It's a serious issue for sure... It's just a legalese nonsense solution that's one sided (and it's not on "our" side), particularly in the US. The serious issue is that they force the law to be argued, they won't be held accountable for bad behavior until that happens.... The real problem with it is how much are you willing to pay for an attorney to argue for you (being they have cleverly eliminated class action suits where high power attorneys would be arguing for you), the answer is it's unlikely that you will have representation of the caliber that "they" will have and you will likely fail and waste your money.

Their TOS and Eula's are chock full of legalese that's dubious at best.

There is a clause somewhere that states you have to pay their legal fees in some particular event(s).

It's entirely to thwart you from taking legal action and shield them from it.

Is it provided at the time of sale?

The ToS can be read before purchase if you want to. If you chose not to read it, that's on you.

It is... but there is a catch.

Can the average consumer be expected to have read the TOS and understand it?

    The obvious answer is no.

The TOS is pretty transparent. It's a guide of things you should not do, and most of those are pretty self-explanatory. For example: Don't stalk other players. Don't harass them. Don't scream racist epithets in chat. This stuff really isn't that hard.
