Blade of Woe Witness Radius

Is there a known distance for how far away a witness needs to be so that you don't get bounty when you use Blade of Woe? I have felt pretty confident on several occasions when crouching behind my target, and the "eye" icon said I was "hidden" so apparently I could not be seen by anyone, but there was an NPC somewhere nearby facing in my direction and I got a bounty. But on another occasion, there were NPCs facing in my direction and I did not get a bounty. Anybody have a good way to tell if the NPCs are far enough away?
