Attack bug

Twice today I got caught when breaking and entering - hard to avoid when they are right beside the door that I have to go through. When this happens they attack me, but I can't attack back. I can run around, but I can't use a door or escape. My only option is to die! This happens every time I'm sneaking. Pretty bad in Abah's Landing.
