Combat during Stealth missions in Hew's Bane

When I am in the beginning Manor mission for the Thieves Guild or the mission to retrieve a ledger in the warehouse, my character is completely unable to fight. I would be able to swing weapons when NOT in combat, but if I am spotted by a guard, I can't swing a weapon or use any skills. Is this a bug or by design? If it is a bug, it is a REALLY big one. My only options are to run (which willl just draw more guards in the warehouse) or die and use a soul gem to resurrect and get as far away from guards as possible. Is this happening to anyone else?

I'd bet dollars to donuts you've got "prevent attacking innocents" turned on in your gameplay options.

Nope, I've been jumping "friendly" creatures in the wild, and hit some civilians in town.

Besides which, when guards show as red before you get to them and they start hitting you, I'd hardly think they were "friendlies".
