Console: Bounty when Hidden

I am receiving bounties when I am completely hidden and I steal something. This happening to anyone else? Does anyone know what causes this and is this a bug? How do I not get a bounty when hidden and stealing an item? This happens every 1 out of 3 times approximately. Playing on Xbox One.
A place where everything and nothing exists, this is my playground.

    Even if the eye is closed if your to close to a npc or not right behind them they will pick up that something is stolen and you get it.

    Are you talking about stealing an item from a crate/barrel or attempting to pickpocket? If pickpocketing, there should be a "xx% of success" that pops up just before you go to steal something from the person. You can still be caught pickpocketing even when completely hidden.

    The NPCs can be facing any way when I steal the item including looking the complete opposite way.

    I'm talking about stealing from an object such as crate or dresser.

    This happens on PC. Not often, but... it's happened to me a few times.
