but if we have the video how the guy from my alliance showing to REDS ( same guild tabard ) where i am. is there chance send him to the ban?

You are tagged and pursued by players from the same alliance, and their guildmates from a different faction then get the easy kill because you have no chance of getting away.

This is not true, not for cloak atleast.
